Selecting a name for a child is of paramount importance for expecting families. While some families adhere to traditional names, modern families are increasingly turning to more unconventional names that reflect their interests. This British family did just that when they decided to name their son Loki Skywalker Mowbray.

 

Loki Skywalker’s father, Christiona Mowbray, has been a lifelong Star Wars enthusiast and was overjoyed to give his son a name that symbolizes the franchise he cherishes. Skywalker is the surname of characters central to the Star Wars film franchise and is currently owned by Disney. The family thought nothing of using the name until recently, when they encountered a snag in planning their family vacation.

Loki’s family was looking forward to a trip to the Dominican Republic and applied for a passport for him. To their dismay, the application was denied by Home Office officials because the name relates to a trademark or copyright issue. In the UK, a passport can be denied if it breaches trademark or copyright laws. The official guideline states that “an application using an existing trade or commercial name will require the applicant to provide written confirmation from the owner of that trademark or copyright that they consent to the use of that name, or confirmation that the name in the public domain is not subject to any copyright or trademark restrictions.”

 

After learning of the possible issue, Mr. Mowbray stated, “I understand the Home Office’s position and reasoning, but I believe they need to recognize that modern names are evolving.” The Mowbrays did not select the name for potential future gain; they simply loved it. Unfortunately, this type of refusal is not the first of its kind. Earlier this year, a six-year-old was denied a passport for the name Khaleesi, a character from the popular series Game of Thrones.

 

Fortunately, the passport office has since amended their decision. They issued an apology for the delay and assured the family that the passport is being processed. The Mowbrays can now continue with their vacation planning. This passport debacle highlights how laws can impact our everyday lives and emphasizes the importance of trademark and copyright protection.
