Breakfast tycoon Kellogg North America Co. LLC has filed a trademark infringement lawsuit against Ohio-based street hibachi food truck named “L’Eggo My Eggroll”.

The Legal Lowdown
The lawsuit was filed in the U.S. District court for the Northern District of Ohio on Tuesday, June 3rd, 2025. It claims that the food truck’s name, branding, colors, and font bear a striking resemblance to the signature Eggo trademark and trade dress. After multiple allegedly “ignored requests” and responses consisting of “threats and demands”, Kellogg claims it had “no other choice” but to take legal action to protect its intellectual property. It’s seeking a court order to bar the use of all infringing branding, destroy any infringing materials, and award damages and attorney fees.

Although the Ohio-based food truck and the Eggo brand may not appear to offer products that are likely to confuse consumers, Kellogg has a strong interest in protecting its brand identity. As a goodwill gesture, Kellogg offered the “L’Eggo My Eggroll” food truck $5,000 to help rebrand its business. However, the food truck company instead demanded that Kellogg purchase its entire business. According to Kellogg’s legal team, the food truck claims that Kellogg is responsible for “medical bills stemming from an alleged reaction to Kellogg’s legal correspondence” and are demanding reimbursements on top of everything else.

Is L’Eggo My Eggroll cooked?
According to the USPTO, Kellogg North America Co. LLC has eleven live and pending trademark applications and registrations for the ‘Eggo’ wordmark and its variations, giving the company grounds to protect its well-established brand. As of the day of this articles creation, it seems they have taken down “L’Eggo My Eggroll” website, though the company is still operating its food truck and are actively posting to its social media pages.
