Buc-ee’s has won its trademark battle against Choke Canyon.
Buc-ee’s filed the federal trademark lawsuit against its competitor in December 2015, stating that Choke Canyon infringed on the Buc-ee’s trademarked logo. The Buc-ee’s logo features a smiling beaver wearing a baseball cap, while Choke Canyon’s logo features an alligator wearing a hat and licking its lips.
The Houston jury was given the duty to determine the strength of the Buc-ee’s trademarked logo, the similarities between both stores, each of their logos, and whether Choke Canyon actually confused or intended to confuse consumers.
The trial lasted a week, and in the end, the jury held for Buc-ee’s after a 6-hour deliberation. Damages are yet to be decided.
