Gucci and GUESS have ended their nine-year-long battle over the famous interlocking “GG” logo on a tan background and diamond pattern.
In 2009 Gucci and GUESS went to court over claims that GUESS was engaging in unfair competition, counterfeiting, and trademark infringement. Gucci alleged the marks were confusing to customers and resulted in lost profits.
The judge awarded Gucci a permanent injunction against GUESS’ use of three of four designs, with $4.7 million in damages, instead of the $221 million previously asked for.
“The agreement is an important step for both companies in recognizing the significance of protecting their respective property portfolios and design creativity,” they jointly stated.
The ruling put an end to pending litigation in Italy, France, Australia, and China.
In 2017, Gucci brought suit against Forever 21 for use of the trademark “green-red-green” and “blue-red-blue” striping.
