Starbucks wins this #trademark #infringement battle! The #Dabuccino bong looks a lot like the Starbucks’ #Frappuccino. With its green straw, domed top, identifiable lady logo, and similar name, it’s certain the company created the Dabuccino with the Frappuccino in mind.
Starbucks doesn’t want any affiliation with the product. They argued that the product was “illfully intended to create an association with the #Starbucks Marks and to capitalize upon the success and popularity of the Starbucks Marks to sell [their] products,” that Starbucks believes “has caused and will continue to cause irreparable injury and damage to Starbucks Corp.’s business, reputation, and goodwill”.
Starbucks asked for profits, as well as damages and attorney’s fees. The artist, James Landgraf, never responded AND didn’t show up in court, so the judge ordered the #artist to pay up to $410,580 in damages. Yikes!! Each piece was sold on the website for $200-$8000.
