Actress Jessica Alba started The Honest Company six years ago, after her daughter got welts from the baby laundry detergent, she was using to wash her daughter’s clothing. She has built a billion dollar business with her HONEST line known for its natural, organic, toxic-, and chemical-free skincare, household cleaning, and now beauty items.
Alba believes that the health company, Honest Herbal, is infringing on her trademark by using “Honest” “to confuse consumers and profit from the goodwill and consumer recognition associated with The Honest Co.’s HONEST Marks. Honest Herbal’s hemp products are created by a pharmacist and licensed hemp grower, Kristy Redmon, who wanted to create alternatives to current medications.
Alba is suing Honest Herbal. Aaron Bradford, a lawyer for Redmon, told Marijuana Business Daily that Alba will not succeed with her lawsuit, and said, “We intend to defend the right of a company to describe their goods as honest”.
This shows the importance of owning rights to your brand. They both sell different types of goods. Do you think that Alba will win this case?
